Loveteddybears is a brand of Bebaby di Bellinzona Barbara which is responsible for data processing and elects the administrator of said individual company as Data Controller and undertakes to respect the privacy legislation (Law 31 December 1996, n. 675) and updated to pursuant to Legislative Decree 30 June 2003 n. 196 and of the European Regulation n. 679 of 05/25/2016 (GDPR).

The sensitive data received from the customer will not be transferred to third parties or used for purposes other than those necessary to process the order or required by law.The personal data, processed by us using IT methods, are collected on servers for exclusive use and downloaded at the registered office to fulfill the obligations imposed by law, regulations, community legislation and to manage the relationships existing at each stage (pre- contractual, contractual, litigation, etc.) and for the time necessary for the execution of the contract or the fulfillment of legal obligations. These data will not be disseminated or communicated to third parties for commercial purposes. The customer can exercise his rights, recognized by the art. 7 Legislative Decree 196/2003 and art. 15-22 Reg. 679/2016, at any time, by writing via PEC or registered letter with return receipt as specified below in the point "REQUESTS TO THE DATA CONTROLLER".

According to the new legislation, the customer has the right to obtain confirmation of the existence or otherwise of the data at Bebaby at any time, to know its content and origin, to verify its accuracy or request its integration or updating, or the rectification or cancellation, to obtain the limitation, portability of the data, as well as to oppose the processing for legitimate reasons, by sending a request to Bebaby as described above.

Furthermore, Bebaby undertakes, only with its specific and distinct consent (art. 7 GDPR), for the following Marketing Purposes to send via e-mail, through the newsletter service, commercial communications and/or advertising material on products or services offered by the Owner and/or to detect the degree of satisfaction with the quality of the services.

The data will be processed, also through the creation and management of a central archive, with paper, IT and telematic supports to which specialized personnel authorized by the Data Controller have access.

The storage of documents is carried out for a period of ten years, provided for by the Civil Code, unless before said term you cease to use our services or cease business, in which case it will be your responsibility to request the paper documentation and the possible deletion of the documents themselves from our computer archive, specifying that, even in the absence of said request, your data will be "blocked" by us with suspension of all processing. These data are deleted by us when the deadline for the control and/or verification of the declarations or reports to which they refer is prescribed by law.

The provision of the Data processed for the aforementioned purpose is mandatory, as necessary for the fulfillment of the relevant obligations. The refusal, expressed with communication by the Customer, to provide data for the aforementioned purpose of completing orders will make it impossible for the Data Controller to follow up on the contract and carry out the activities instrumental to achieving the purposes.In any case, the Customer may object at any time to the receipt of commercial communications even having given consent.

With the express and specific consent, acceptance of the conditions of sale and finalization of the order at LoveTeddybears, the Customer gives the Data Controller permission to process his Data for automated decision-making processes (Customer Profiling). In particular, customer profiling through third-party cookies.Profiling takes place through Google Analytics, a third-party cookie that provides anonymous and aggregate analysis of behavior (such as, for example, amount spent, frequency of purchases, value of the cart) of the navigators on the site itself: for further information on the functioning of Google Analytics you can consult the Google information.

REQUESTS TO THE DATA CONTROLLER

The elected data controller of the loveteddybears brand is the administrator of the aforementioned Bebaby company of Bellinzona Barbara. Any request in this regard can be forwarded by registered mail with return receipt addressed to:

In any case, the prohibition on communicating or disseminating your personal data to parties not necessary for the performance of the services or products requested by you remains in force.

The Customer's Rights are listed below.In relation to the processing of personal data, the interested party has the right, pursuant to art. 7 (right of access to personal data and other rights) of the Privacy Code:

1. The interested party has the right to obtain confirmation of the existence or otherwise of personal data concerning him, even if not yet registered, and their communication in an intelligible form.

2. The interested party has the right to obtain the indication:
of the origin of the personal data;
of the purposes and methods of processing;
the identification details of the owner, managers and representative designated pursuant to article 5, paragraph 2;
of the subjects or categories of subjects to whom the personal data may be communicated or who may become aware of them as designated representatives in the territory of the State, managers or agents.

3. The interested party has the right to obtain:
updating, rectification or, when interested, integration of data;
the cancellation, transformation into anonymous form or blocking of data processed in violation of the law, including those whose retention is not necessary in relation to the purposes for which the data were collected or subsequently processed;
the certification that the operations referred to in letters a) and b) have been brought to the attention, also with regard to their content, of those to whom the data have been communicated or disseminated, except in the case in which this fulfillment proves impossible or involves the use of means that are manifestly disproportionate to the protected right.

4. The interested party has the right to object, in whole or in part:
for legitimate reasons to the processing of personal data concerning him, even if pertinent to the purpose of the collection;
to the processing of personal data concerning him for the purposes of sending advertising material or direct sales or for carrying out market research or commercial communication.

COMMUNICATION OF CONSENT TO DATA PROCESSING:

The customer, by sending the electronic confirmation of his purchase order, acknowledges the information and consents to the processing of the personal data provided.

The telephone numbers entered during registration or confirmation of an order will be used exclusively to process the order and communicated to the express courier (request necessary for shipping) or in extreme cases for urgent communications on orders in the event of no response via email or otherwise notification system provided by our e-commerce.
